1. Agreement

These Terms of Use ("Terms") govern your access to and use of the Sound Mod website, including the preset catalog, documentation, contact forms, and related application programming interfaces (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

2. Changes

We may modify these Terms at any time. We will update the "Last updated" date above when we make material changes. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms, to the extent permitted by applicable law. The current version is always available at /terms.

3. Eligibility

You represent that you are of legal age to form a binding contract in your jurisdiction and that you are not barred from using the Service under applicable law. If you use the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

4. Description of the Service

The Service may include browsing and searching a catalog of sound presets, reading documentation, submitting feedback or support requests, creating or managing preset-related content where such features are offered, and accessing APIs that expose catalog or metadata information. Features may change, be limited, or be discontinued without notice.

5. Presets, media, and third-party content

Presets, audio samples, images, icons, and other materials displayed in the catalog may be owned by their respective authors or licensors. Listing in the catalog does not grant you any licence beyond what is expressly stated in the item description, accompanying licence text, or applicable law. You are solely responsible for complying with all licence terms, copyright notices, and usage restrictions when you download, modify, redistribute, or otherwise use such materials.

6. Acceptable use

You agree not to:

The Sound Mod name, logos, site design, and original text and graphics on the Service (excluding third-party preset assets as described above) are protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, no rights are granted to you. You may not copy, modify, or reverse engineer proprietary parts of the Service except where mandatory law allows.

8. APIs and technical limits

Where APIs are provided, they are offered for legitimate use in line with these Terms. We may apply authentication, throttling, quotas, or IP restrictions. We reserve the right to block abusive traffic or revoke access that harms the Service or other users.

9. Third-party services

The Service may link to third-party websites, browser extension stores, or tools. We do not control and are not responsible for third-party content or practices. Your use of third-party services is at your own risk and subject to their terms and policies.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Some jurisdictions do not allow certain disclaimers; in those jurisdictions, disclaimers apply to the maximum extent permitted by law.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE OPERATOR OR ITS SUPPLIERS OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (USD 100), IF YOU HAVE NOT PAID ANYTHING.

You will defend, indemnify, and hold harmless the operator and its affiliates, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party (including intellectual property or privacy rights).

13. Suspension and termination

We may suspend or terminate your access to all or part of the Service at any time, with or without notice, for conduct that we reasonably believe violates these Terms, creates risk or legal exposure, or harms users or third parties.

14. Governing law and disputes

These Terms are governed by the laws applicable to the operator of the Service, without regard to conflict-of-law rules that would require applying another jurisdiction's laws. Courts located in that jurisdiction shall have exclusive venue for disputes arising from these Terms or the Service, unless mandatory consumer protection laws in your country grant you non-waivable rights to sue in your home courts.
